2. Service Description

Conversate and Learn provides a platform that combines secure messaging with AI-powered language learning tools. Our Service enables you to:

• Communicate with friends and contacts in the language you're learning
• Receive real-time AI assistance with grammar, translations, and language corrections
• Access language learning features integrated into your messaging experience
• Track your language learning progress

3. Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

Users under 18 should review these Terms with a parent or guardian to ensure they understand them.

4. User Accounts

4.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

6. User Content

6.1 Your Content

You retain all rights to the content you create, upload, or share through the Service ("User Content"). By sharing User Content through the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service to you.

6.2 AI Processing

You acknowledge that our AI features may process your messages to provide language learning assistance, corrections, and translations. This processing is performed in real-time and we do not store your message content beyond what is necessary to provide the Service.

6.3 Content Responsibility

You are solely responsible for your User Content. We do not endorse, support, represent, or guarantee the truthfulness, accuracy, or reliability of any User Content.

7. Messaging Services

7.1 End-to-End Encryption

We implement end-to-end encryption for your messages. However, you acknowledge that AI assistance features require processing your message content, which may temporarily decrypt messages for processing purposes.

7.2 Message Retention

Messages are stored on your device and the devices of your conversation partners. While you can delete messages from your device, we cannot control or delete messages stored on other users' devices.

7.3 Communication Standards

You agree to communicate respectfully and appropriately with other users. Harassment, abuse, or inappropriate behavior may result in account termination.

8. Subscription and Payment

8.1 Subscription Plans

We offer both free and premium subscription plans. Premium features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis.

8.2 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You will be charged the then-current subscription fee upon renewal.

8.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial subscription periods, except as required by law.

8.4 Price Changes

We reserve the right to change our subscription prices. We will provide you with reasonable advance notice of any price changes, and you will have the opportunity to cancel before the new price takes effect.

9. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Conversate and Learn Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without our prior written consent. All other trademarks, logos, and service marks are the property of their respective owners.

10. Termination

10.1 Termination by You

You may terminate your account at any time by following the account deletion process in your settings or by contacting us.

10.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms
• Harms other users or the Service
• Exposes us to liability
• Is otherwise inappropriate or unlawful

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and content, though messages sent to other users will remain on their devices.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Service will meet your expectations
• Any AI-generated language corrections or translations will be completely accurate

You use the Service at your own risk. We are not responsible for any learning outcomes or language proficiency achieved through use of the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONVERSATE AND LEARN INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
